It is important to carefully read all conditions for the access and use of this Web site (hereafter: « the Site »).
By using the Site, you agree to be bound by these conditions.
If you do not accept these conditions or if you do not expect to abide by them, please refrain from using this site.
Please note that the conditions may be modified at any time. The use, after posting of such changes, constitutes acceptance of the modified conditions. It is your responsibility to consult the conditions when using the Site.
The Fédération des producteurs de bovins du Québec (hereafter: « the Fédération ») is the owner and administrator of the Site.
The site cannot, in any way, be submitted under the form of a hyperlink by anyone without the written and express consent of the Fédération.
All content of Site or that accessibly through it, including texts, photos, pictures, graphs, illustrations, software and other documents, are protected by copyright. This content and copyrights of this content belong either to the Fédération or to the person whose name is listed as the copyright holder or are under license for use by one or the other. The content of the Site can only be used or reproduced for personal use, not commercial. In no event shall the content of the Site be, in whole or in part, used, sold, exchanged, disposed of, alienated or otherwise exploited for any commercial purpose or remuneration, profit or other advantage.
Without limiting the extent of the foregoing, but with the exception of what is expressly provided herein, any form of use, reproduction, modification, publication, public performance or availability to the public, download, transfer, display, transmission, redistribution or other exploitation of the Site or any Site content, in whole or in part, is forbidden without the prior written and express consent by the Fédération.
No element on the Site may be construed to grant any right, title, interest or license such as texts, photos, images, illustrations, software and other documents contained in the Site.
Veau de grain du Québec, Veau de lait du Québec, Bovitrace, Bœuf qualité plus are Fédération registered trademarks. Other names, words, titles, phrases, logos, drawings, graphs, icons and trademarks posted on the Site can equally constituted trademarks registered by the Fédération or third parties.
Any form of use, reproduction, modification, publication, public performance or availability to the public, download, transfer, display, transmission, redistribution or other exploitation of a trademark appearing on the Site without prior written and express consent by the Fédération or copyright holder of the trademark, is forbidden and constitutes a violation of the Trade-marks Act.
Nothing on the Site may be construed to grant any right, title, interest or license for the use of any logo, drawing, Fédération or third party trademark, contained in the Site.
Even if the Fédération can use, under license, certain third party trademarks, the posting of third party trademarks on the Site does not presuppose of a relation between the Fédération and the owner of the trademark, nor the approval of the merchandise, the services or activities of the owner of the trademark in question.
Personal information means any information on a user of the Site, supplied by him in a voluntary manner and permitting his identification.
Personal information may be requested when using the Site, including when information is transmitted to a third party through the Site or that information is supplied for the purposes described on the Site. All personal information will only be used by the Fédération for the purposes described on the Site. Any user can refuse that personal information be used for future purposes and / or request that such information be removed from the databases of the Fédération, notifying the Fédération by email, fax or regular mail.
Information transmitted over the internet is generally not secure. The Fédération cannot formulate and makes no representations or guarantees regarding the security and confidentiality of any communication through the Site, nor any declaration or guarantee regarding the interception by third parties of data or information, including personal.
The Fédération works to ensure the accuracy and reliability of the content of the Site. However, the content and / or information contained therein is provided as is and the Fédération cannot be held liable to any user or third parties for typographical errors or other, inaccuracies or omissions of any kind in the content of the Site. The site provides access, through hyperlinks, to other sites. These hyperlinks are provided solely for the convenience of the users and this cannot be construed as an endorsement by the Fédération, express or implied, of the content of these sites or products and services offered. Unless otherwise expressly specified, these sites are not managed or controlled by the Fédération and it cannot be held responsible for their content. The Fédération makes no guarantees of any nature whatsoever in respect to these other sites.
Information contained on the Site is provided for informational purposes only and cannot be regarded as legal advice, accounting, tax, business or other, and the Fédération cannot be held responsible in any way whatsoever following the use of the information contained in the Site by anyone referring to the Site in order to obtain such advice.
APPLICABLE LAW AND JURISDICTION
The Site and its content are administered by the Fédération from its offices located in the province of Quebec, Canada. The Site is intended for the residents of the province of Quebec. Consequently, the Site and its content are governed and interpreted exclusively in compliance with the laws of the province of Quebec and Canadian laws applicable in this province.
Access and use of the Site shall be deemed to have been done from the province of Quebec and you, irrevocably and expressly, acknowledge the exclusive jurisdiction of the courts of the province of Quebec sitting in and for the judicial district of Montreal regarding the Site, its use and its content.
Any person who uses the Site expressly and irrevocably waives the right to any objection based on the lack of territorial jurisdiction or any request based on the concept of forum non conveniens (Article 3135 of the Quebec Civil Code).On the other hand, it is incumbent upon any person who accesses the Site from a location in a territory other than the province of Quebec to check and ensure, in particular with its own legal counsel, compliance with applicable laws of the place from which the use of the Site is done. Access and use of the Site is only permitted in countries or territories where all the stipulations made within these conditions shall apply and have full effect.
Any person who accesses or uses the Site ensures the Fédération that it does not use the site for purposes forbidden by law and commits, in this regard, to abiding by all local, national and international applicable laws.
The present conditions of use constitute the entire agreement between the Fédération and any person who accesses or uses the Site.
The fact that a condition has been declared null, invalid or otherwise inapplicable by a competent tribunal does not affect, in any way, the validity of the other provisions.
The failure by the Federation to insist on strict compliance or to enforce any provision herein does not constitute a waiver of any provision or right.
Only the French version of these conditions is the official version and it will prevail over any other version.
